Welcome to Pixcel360! These Terms of Service (“Terms”) govern your use of our application, website, and services. By accessing or using Pixcel360, you agree to these Terms. If you do not agree, please do not use our services.

 

1. Definitions

• “Pixcel360” refers to our app, website, and related services.
• “User”, “you,” or “your” refers to any person or entity accessing our platform.
• “Content” includes photos, videos, overlays, and any media uploaded or generated using Pixcel360.

 

2. Eligibility

You must be at least 13 years old to use Pixcel360. If you are under 18, you may use the services only with parental or guardian consent.

 

3. Account Registration & Security

• You may be required to create an account to access certain features.
• You are responsible for maintaining the confidentiality of your login credentials.
• Notify us immediately if you suspect unauthorized account activity.

 

4. Acceptable Use

By using Pixcel360, you agree NOT to:

• Violate any laws, including intellectual property or privacy rights.
• Upload illegal, offensive, or harmful content.
• Use Pixcel360 for unauthorized commercial purposes.
• Attempt to hack, disrupt, or reverse-engineer the service.

 

5. Payment & Subscriptions

• Pixcel360 offers subscription-based services with recurring fees.
• Payments are processed via third-party providers, and refunds are subject to our Refund Policy.
• You can cancel your subscription at any time, but no refunds will be issued for the current billing period.
• Pixcel360 does not offer in-app purchases or subscriptions through Google Play or the Apple App Store. All subscription payments are processed externally through our website or trusted third-party payment partners. No billing is conducted via your Google or Apple account

 

6. Intellectual Property

• Pixcel360 retains all rights to its software, trademarks, and branding.
• You retain full ownership of all photos, videos, overlays, and other content you create or upload using Pixcel360 (“User Content”). By using our services, you grant Pixcel360 a limited, non-exclusive, worldwide license to process, store, transmit, and display your User Content solely for the purpose of operating, maintaining, and improving the Pixcel360 platform and its functionalities.

 

• This license does not allow us to use your content for advertising, marketing, or promotional purposes unless you provide explicit, separate consent. You may revoke such marketing consent at any time.

 

• We do not claim ownership of your User Content, and we do not sell, license, or distribute your content to third parties for commercial use.

 

• Media files uploaded or created using Pixcel360 will be stored securely on AWS servers for up to 60 days, after which they will be permanently deleted unless removed earlier by you

 

7. Data Privacy

Your use of Pixcel360 is also governed by our Privacy Policy www.pixcel360.com/privacy-policy . We do not sell your data, but we may process and store it to provide our services.

 

8. Content Removal & Account Termination

We may remove content or suspend accounts that violate these Terms. If your account is terminated for breaches, you will not receive a refund.

 

9. Limitation of Liability

• Pixcel360 is provided “as is” without warranties.
• We are not liable for data loss, service interruptions, or third-party actions.
• Our total liability for claims related to Pixcel360 is limited to the amount paid in the past three months.

 

10. Dispute Resolution

These Terms are governed by the laws of South Africa. Users located in South Africa retain all rights under the South African Consumer Protection Act, 2008 (CPA).

For users outside South Africa, these Terms are governed by the applicable laws of your country of residence, without limiting any mandatory consumer protection rights in your jurisdiction.

Any disputes should first be attempted to be resolved through good-faith negotiation. Where applicable and voluntary, disputes may be referred to mediation or arbitration. Arbitration is voluntary, and users retain the right to pursue claims in a court of competent jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.
